Jervis Bay Rentals Terms and Conditions

Before you book

  • Please call us to discuss any special requirements you may have (don’t rely on website information alone).
  • We may be able to offer early arrival and late departure outside peak periods.  We will let you know how before arrival.
  • Our cancellation policy is industry leading.  20% deposit, full refund (less a processing fee) if cancelled within 24 hours of making a booking, and flexibility if you need to change properties and/or dates (with sufficient notice).


  • Payment of a deposit constitutes acceptance of these Terms and Conditions.
  • The full stay cost is required to be paid within 28 days of arrival.
  • A 20% deposit is required for a booking more than 28 days in advance.
  • Your quoted tariff consists of an accommodation component (held in trust for the owners of the property) and a booking fee (payable to Jervis Bay Rentals).
  • Jervis Bay Rentals reserves the right to cancel (subject to a full refund) a booking if:
    • they deem the property to be unsuitable for the Guests who booked;
    • it is determined that rate the property was advertised at was more than 10% less than the actual rate.  This happens very occasionally due to technological issues.
  • All amounts quoted are in Australian Dollars

Online Check in (Guest Registration)

  • You are required to provide us with photo ID and a credit card in the name of guest.  This is done by an online Check In page before you arrive.
  • Completion of the online check in is a condition of entry to the property and the names and phone numbers of all adult guests staying at the property must be completed in the online check in.


  • After 3pm (unless otherwise arranged).
  • Entry is via a coded door lock or similar.  We will send you the code in advance.
  • A document containing House Rules and other information pertinent to the property will be present inside the property.  The instructions contained within must be adhered to during your stay.


  • Before 10am (unless otherwise arranged).
  • The property must be left clean and tidy.

Cancellation or Variation

  • All bookings cancelled within 24 hours of initial payment will receive a full refund (less a processing fee).
  • Bookings cancelled more than 28 days prior to arrival will incur a cancellation fee calculated as 20% of the total cost of the booking (i.e. usually your deposit).
  • Bookings cancelled within 28 days of arrival will forfeit 100% of the total cost of the booking. However, if Jervis Bay Rentals can rebook any of the cancelled nights, we will refund you 90% of whatever the new guest pays for those nights.
  • Where a deposit hasn’t been received within 3 days of booking, the booking will be cancelled.
  • If the property becomes unavailable for your occupancy due to unforeseen circumstances (eg fire, storm damage, sale, sustained road closures etc) then we will inform you and endeavour to obtain suitable alternative accommodation for your stay.  If suitable accommodation can’t be sourced, a full refund will be offered.
  • If a booking is taken based on incorrect rates or where a property is unavailable, Jervis Bay Rentals reserves the right to cancel the booking or re-offer it to you at the correct rate.  Technical issues are rare, but they do occur.
  • Bookings made after 1 April 2020 (at which time Covid-19 is considered a “known” event) that are cancelled due to a government advisory not to travel due to Covid-19 restrictions will be entitled to a Guest Credit or change of dates penalty free.  A refund will not be offered.
  • The booking is made in good faith by us as the agent, however, we cannot be held responsible for actions by an owner, such as changes to a property and/or its inclusions or withdrawal of a property, prior to occupancy.

It is strongly advised that guests carry suitable travel insurance that covers cancellations.

Although we will be as flexible as possible, refunds are generally not permitted for circumstances including:

  • A change of travel plans
  • Disruptions to transportation to the property
  • Illness
  • A lack of access to attractions (such as Booderee National Park, wineries, Jervis Bay) due to factors beyond our control (such as bushfire, inclement weather, worker’s strike etc)
  • Forecast weather or other environmental impacts (such as rain, smoke haze, extreme heat or cold, high winds, bushfire, floods etc) where they do not directly impact your ability to access the property.


  • All approved refunds will attract a fee of $100, plus a 2% processing fee for bookings paid with credit card.
  • No processing fee will apply where a Guest Credit Voucher is issued in lieu of a refund.

Security Deposit

  • Payment of the Deposit constitutes authorisation for Jervis Bay Rentals to pre-authorise your credit/debit card for up to the Security Bond amount (between $750 and $2,000) prior to, during or within 7 days of departure of your stay.  This is a condition of entry to the property.
  • Any damage, loss or expense incurred by Jervis Bay Rentals or the Owners of the property as a result of your breach of these Terms and Conditions will be charged against the security deposit (see Fees and Penalties below for examples).  It is very rare that we claim monies (less than 0.5% of bookings).  Where we do:
    • it is clear that either the property or neighbours have not been respected; or
    • the property hasn’t been left in a clean and tidy state; or
    • damages, cleaning or other breaches are significant.

Fees and Penalties (inclusive of GST)

  • Excess cleaning requirements: charged at $55/hr
  • Dirty barbeque: $55
  • Late departure: 50% of the nightly rate on the day of departure
  • Missing keys: cost of changing of the locks and three sets of keys
  • Missing door/garage remote controls: the cost of re-coding and replacing the remote control
  • Breakages, missing items, damage to the property: Charged at replacement or repair value plus delivery and installations costs
  • Extra guests beyond those declared: $200 per guest per night
  • Drain and clean pool (broken glass, oil contamination etc): at cost (usually over $800)

Parties, Functions and Gatherings

  • Disturbance to neighbours, including excessive noise, is prohibited and will result in termination and eviction without refund and extra charges may be made for security and other expenses. All costs relating to the termination and eviction will be borne by you and you will be liable for a penalty equivalent to the security bond.
  • Jervis Bay Rentals have a strict zero tolerance policy when it comes to parties. Guests must move inside from 10pm and keep noise levels to a minimum.
  • Groups not permitted to stay at any properties managed by Jervis Bay Rentals include (but are not limited to): bucks and hens parties, school leavers groups and weddings.
  • Should Jervis Bay Rentals be required to call the security company to deal with excessive noise or parties, the guest will be charged a minimum fee of $300

Pets (for properties that allow pets)

Well behaved pets are welcome at a lot of our properties.  If there is a chance that your pet will disturb the neighbours (e.g. excessive barking) or damage the property, please don’t bring them on your holiday.

  • Cats are not permitted
  • Pets must not be left inside the property unattended
  • Pets must not enter fenced pool areas
  • Undeclared pets are not permitted
  • Extra charges may be incurred where pets damage property or result in extra cleaning requirements, particularly relating to pet hair, scratches on doors and pet faeces not being cleaned up.

The Short Term Rental Code of Conduct

In summary

  • Guest behaviour must comply with:
    • the Code of Conduct
    • criminal laws
    • planning laws
    • by-laws, if the premises are in a strata or community land scheme
    • terms of the short-term rental arrangement.
    • any other laws.
  • The guest must not at any time:
    • make noise that is unreasonably disruptive or interferes with the peace and comfort of neighbours and other occupants
    • act in a violent or threatening manner
    • act in a manner that could reasonably cause alarm or distress to neighbours and other occupants
    • use or enjoy the premises in a manner that unreasonably interferes with the use or enjoyment of common or association property in a strata or community land scheme by neighbours or other occupants
    • intentionally, recklessly or negligently damage the personal property of neighbours or other occupants.
    • A guest must not copy, or knowingly retain, any keys or security passes at the end of the occupancy.
  • Reasonable care must be taken of the host’s premises and property at the premises.
    • If there are disputes or complaints about the behaviour of a guest or visitor, the guest must notify the host or their representative as soon as possible. For example, if a neighbour complains about the behaviour or noise of guests and visitors, the host must be notified.
  • Guests who have been recorded on the Exclusion Register are not allowed to be a guest at any short-term rental premises in NSW.
  • Visitors are people who, with the guest’s consent, are present at the premises during the occupancy.
    • Guests are responsible for any visitors they invite onto the premises and must ensure that the visitors comply with the obligations to neighbours. 

The rest of the fine print…

  • Bookings made via 3rd party organisations (e.g. Stayz, Airbnb, are also subject to their Terms and Conditions and cancellation policies.
  • You must be over 18 at the time of booking.
  • Tariffs will vary from time to time depending on demand and owner requests.  You will not be eligible for a discount, nor will you have to pay a premium if the quoted rate for your booking period changes.
  • Smoking is strictly prohibited inside the property.
  • The Guest is liable for all costs relating to damage to the property or contravention of the terms and conditions.  This is not limited to the amount of the security deposit.
  • The premises is to be securely locked whenever you leave it vacant and once you depart.
  • Swimming pool safety must be observed and complied with in accordance with legislative requirements. Guests must ensure pool access gates are secured at all times and children are properly supervised.
  • No responsibility is taken for guest’s or visitor’s personal property at the premises.
  • Guest’s and visitor’s vehicles must only be parked in designated areas.  Please don’t park on the grass.
  • Any area of the property which is locked and for which a key has not been supplied is private and not for guests use. Gaining unlawful access is a breach of this agreement and legal action may be taken.
  • No additional mattresses, tents or caravans are permitted in the property or on the grounds at any time.
  • The Property is to be rented for holiday purposes only.
  • The barbeque supplied with the property is the only one permitted to be used on the property.
  • No compensation will be offered for disturbance or disruption to a Guests’ stay where that disturbance or disruption is beyond the control of Jervis Bay Rentals.
  • In addition to the declared guest numbers, a further 6 (six) visitors are permitted on the property, but must not stay overnight.
  • Guests are required to allow repair/service access to the property during reasonable hours.
  • In the case of any problem or complaint, you must inform Management at the earliest opportunity so that Management has the opportunity to rectify the situation as quickly and efficiently as possible.
  • While we do our best to ensure the photos and description of the property on our website and other 3rd party websites is accurate, they should not be relied upon as properties are being constantly upgraded or altered.  If you have a special requirement you must let us know before booking.
  • No responsibility or liability is accepted or undertaken by Jervis Bay Rentals, its employees, agents or contractors for any death, injury, accident, damage or loss of personal property (including baggage) or any other matter arising from any act, omission or issue outside of their control.
  • Jervis Bay Rentals cannot accept responsibility for any actions taken by the owner of the premises outside Jervis Bay Rentals’ control.
  • Minor overpayments will result in an adjustment to the booking account rather than a refund.
